This Boudoir Photography Agreement is entered into by and between Rebecca-Kay Francis, doing business as Bec-Kay Boudoir (“Photographer”), and the undersigned client (“Client”). This Agreement is legally binding and covers the provision of boudoir photography services as outlined herein.

1. Services Provided: Photographer agrees to provide boudoir photography services to the Client at the location and on the date and time agreed upon by both parties. The scope of services includes photography session planning, the photography session itself, post-session photo editing, and delivery of final images to the Client.

2. Payment and Fees: Client agrees to pay Photographer the agreed-upon fee for the photography services. A non-refundable deposit is required to secure the session date, with the balance due on the day of the session. Additional purchases or upgrades are subject to separate charges.

3. Cancellation Policy: In the event of cancellation by the Client, the deposit is non-refundable.

4. No Refunds Policy: Due to the custom nature of photography and the service-based nature of Bec-Kay Boudoir, no refunds will be issued once the photography session has taken place and/or final images have been delivered to the Client. The Client acknowledges that photography is inherently subjective, and Bec-Kay Boudoir will endeavor to meet the Client’s expectations within the bounds of the Photographer’s style and expertise.

5. Copyright and Usage Rights: Photographer retains copyright of all images produced. The Client is granted a personal use license for the delivered images. Images may not be altered, sold, or used for commercial purposes without the express written consent of the Photographer.

6. Model Release: Client grants Photographer the right to use images from the session for promotional, advertising, and marketing purposes unless otherwise agreed in writing.

7. Privacy and Confidentiality: Photographer agrees to maintain the confidentiality of all images and personal information provided by the Client, except as otherwise permitted under this Agreement or as required by law.

8. Limitation of Liability: Photographer’s liability for any claim, breach, or damage by reason of any act or omission shall be limited to the return of payments received for services rendered under this Agreement.

9. Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior and contemporaneous agreements, representations, and understandings of the parties.

10. Amendments: No amendment, change, or modification of this Agreement shall be valid unless in writing signed by both parties.

11. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Australia.

By signing below, the Client acknowledges they have read, understood, and agree to be bound by the terms of this Agreement.
